GUIDELINES AND SCHEDULE FOR THE SUBMISSION AND ANALYSIS OF THE PROJECT MONITORING REPORT (RDAP)

The Project Monitoring Report (RDAP) must be submitted in accordance with the guidelines established in SUFRAMA Ordinance No. 745/2023. Its submission and analysis follow the schedule below:
1) Submission of the RDAP
The Report must be submitted by June 30, 2024, based on the fiscal year 2023.
2) Analysis of the RDAP
The Superintendence of the Manaus Free Trade Zone (SUFRAMA) will conduct the analysis of the Report, verifying compliance with the obligations set forth in SUFRAMA Ordinance No. 745/2023.The analysis is carried out by the General Coordination for Industrial Project Monitoring (CGAPI) of SUFRAMA and includes verification of the following items:
Compliance with the indicators established in the technical-economic project;
Compliance with the Basic Production Process (PPB);
Compliance with obligations related to Research, Development and Innovation (R&D) investments; and
Compliance with ancillary obligations (Independent Audit Technical Report – LTAI, ISO 9000 Quality Certification, Environmental License).
In case of a notification from SUFRAMA regarding questions about the RDAP, the company will have a non-extendable period of 15 days to respond, counted from the date of receipt of the official letter, under penalty of application of the legal measures provided for in Article 35 of Resolution No. 205, dated February 25, 2021.
3) Issuance of the Project Monitoring Opinion (PAP)
After the analysis is completed, the Agency, through CGAPI, will issue the Project Monitoring Opinion (PAP), which will be sent to the company.This document will include information on compliance with the obligations established in SUFRAMA Ordinance No. 745/2023, as well as the conclusion regarding the approval or rejection of the RDAP.
4) Company’s Defense
If the PAP recommends total or partial rejection of the RDAP, the company will have a 30-day period to present its defense, which must also be submitted electronically through SUFRAMA’s system.
5) Final Decision
The final decision on the RDAP will be issued by SUFRAMA after analyzing the company’s defense.If the RDAP is rejected, the company will have 15 days to regularize the situation. However, if the company fails to comply within the established period, SUFRAMA may suspend the approval acts of the Technical-Economic Project and refer the case to the SUFRAMA Administrative Council (CAS) for deliberation on definitive cancellation.
